Pedestrians Crossing In Unmarked Crosswalks Can Make Still Make An Accident Claim
Did you know that even a pedestrian crosses the street outside of a marked crosswalk, someone who kills or injures you can still be held liable for the crash?
This is because of something called an “unmarked crosswalk.”
A crosswalk is not just the points between the corners of an intersection that are painted; but the points between any intersection, painted or not.
So, a driver MUST yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, per Vehicle Code § 21950(a). It did not happen here, and an innocent life was lost.
